Sharing State Pensions on Divorce

April 2017        No: 1

When couples divorce, or end a civil partnership, they can make financial claims against each other.

What is often overlooked, is that the Court can look at additional state pensions, regarding them as financial assets. They can be shared by the making of a pension sharing Order.

When negotiating a financial settlement, or applying to the Court, both parties should therefore obtain information about their state pensions.

The DWP has recently updated the form (BR20), which must be submitted to obtain this information.

This is available from the DWP website.
